According to art. 79 sec. 1 item 3 of the Act on Civil Status Records, a foreigner intending to enter into marriage shall submit a document stating that, in accordance with the applicable law, he or she may enter into marriage.

The document should be issued by a public administration body of the country of which the foreigner is a citizen. However, obtaining the document by a foreigner is not always possible. Not every country provides for the issuance of a document with the indicated content. An obstacle to obtaining the document may also be the war in the country and the resulting difficulties in the operation of the public administration.

If obtaining the indicated document encounters obstacles that are difficult to overcome, the court in non-contentious proceedings may, at the request of the foreigner, exempt him or her from submitting this document. In the proceedings for exempting a foreigner from submitting the document, the court determines, based on the applicable law, whether this person may enter into marriage.
